Abby R. Bitzenburg

Staff Attorney

Abby’s practice focuses on water, natural resources, administrative, and real property issues. Based in Marten’s Twin Falls, Idaho office, Abby represents individual water users, canal companies, municipal providers, and irrigation districts in a wide variety of matters. She has experience with water right permitting, adjudication, and administration issues throughout the state of Idaho.  

Abby graduated cum laude from Lewis & Clark Law School in 2023 with a certificate in Environmental and Natural Resources Law. During law school, Abby was a student clinician with Earthrise Law Center where she gained experience with the Clean Water Act (CWA), National Environmental Policy Act (NEPA), Federal Land Policy and Management Act (FLPMA), Comprehensive Environmental Compensation and Liability Act (CERCLA), and Toxic Substances Control Act (TSCA), among other environmental statutes.

Growing up on a farm on the Salmon Tract of southern Idaho instilled a deep understanding and passion for water law issues that led Abby to pursue a law degree with a specific concentration on environmental law.

  • Represents multiple canal companies and irrigation districts regarding conjunctive administration of surface and ground water rights related to the Eastern Snake Plain Aquifer.
  • Represents municipal water providers concerning water right procurement, transfer, and adjudication of water rights.
  • Advises ranchers and farmers on water use and property rights matters.
  • Represents canal companies regarding water quality regulation and development of TMDLs and implementation plans in southern Idaho.
  • Represents water users on compliance proceedings before the Idaho Department of Water Resources.
  • Represents water users in the ongoing water adjudications in Idaho.
  • Represents mining companies and insureds to obtain insurance coverage for claims arising from environmental cleanups.
  • Represents a municipal wastewater system in an appeal of the Clean Water Act discharge permit before a state administrative hearing authority.
  • Represents family agricultural businesses in a basin-wide water rights adjudication.
